Definition of statutory undertaker

19.  For paragraph (c) of the definition of “statutory undertaker” in—

(a) article 2(1) of the East Kent Light Railway Order 1993; and

(b) article 2(1) of the Wye Navigation Order 2002(3);

there shall be substituted—

“(c) a provider of an electronic communications network in whose case the electronic communications code is applied by a direction under section 106 of the Communications Act 2003.”.
