This Order brings into force section 148 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (c. 10) (“the 2012 Act”). This section amends section 76 of the Criminal Justice and Immigration Act 2008 (c. 4) (“the 2008 Act”), which provides a gloss on the common law of self-defence and the defences provided by section 3(1) of the Criminal Law Act 1967 (c. 58) and section 3(1) of the Criminal Law Act (Northern Ireland) 1967 (c. 18 (N.I.)). Section 148 of the 2012 Act amends section 76 of the 2008 Act so that the law relating to self-defence and related defences is set out clearly in one place.
