7. The transfer of functions exercisable under or by virtue of paragraph 4 of Schedule A1(1) to the 1987 Act has no effect to the extent that those functions arise in circumstances where—
(a)paragraph 4(1) of Schedule A1 to the 1987 Act applies; and
(b)the applicant has appealed to the Secretary of State under paragraph 4(3) of that Schedule,
and that appeal has not been finally determined before 1st April 2018.
Schedule A1 was inserted by S.I. 2003/1230.
