The Marketing of Vegetable Plant Material Regulations 1995E+W

25.—(1) The Marketing of Vegetable Plant Material Regulations 1995 M1 are amended as follows.

(2) In regulation 5(d)(i), for “the Vegetable Seeds Regulations 1993 M2” substitute “ the Seed Marketing Regulations 2011 M3.

(3) In regulation 8(4), for “the Vegetable Seeds Regulations 1993” substitute “ the Seed Marketing Regulations 2011 ”.

The Marketing of Ornamental Plant Propagating Material Regulations 1999E+W

26.—(1) The Marketing of Ornamental Plant Propagating Material Regulations 1999 M4 are amended as follows.

(2) In regulation 2(1)—

(a)omit the definition of “Directive 77/93/EEC”;

(b)in the definition of “Directive 98/56/EC”, at the end insert “ , as last amended by Regulation (EU) No 652/2014 of the European Parliament and of the Council M5;

(c)after the definition of “Directive 98/56/EC” insert—

Directive 2000/29/EC” means Council Directive 2000/29/EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community M6;.

(3) In regulation 7(4), for “regulation 15 of the Plant Health (Great Britain) Order 1993 M7” substitute “ article 25 of the Plant Health (England) Order 2015 M8.

(4) In regulation 8(3)—

(a)for the words from “plant pest” to “1993” substitute “ notifiable plant pest as defined in article 42(3) of the Plant Health (England) Order 2015 ”;

(b)for “article 20” substitute “ article 42 ”.

(5) In regulation 9(2), for “Council Directive 77/93/EEC” substitute “ Directive 2000/29/EC.

(6) In regulation 12(3), for the words from “article 12(5)” to the end substitute “ article 9(1) of the Plant Health (England) Order 2015 ”.

The Marketing of Fresh Horticultural Produce Regulations 2009E+W

27.  In regulation 2(2) of the Marketing of Fresh Horticultural Produce Regulations 2009 M9, for the definition of “Regulation (EU) No 2013” substitute—

Regulation (EU) 2013” means Regulation (EU) No 1308/2013 of the European Parliament and of the Council establishing a common organisation of the markets in agricultural products, as amended from time to time;.
