Seiliau dros apelio yn erbyn dyroddi hysbysiadau adfer
3.—(1) Gellir gwneud apêl o dan adran 71(1)(a) o'r Ddeddf yn erbyn dyroddi hysbysiad adfer gan yr awdurdod perthnasol ar y sail—
(a)nad yw uchder y gwrych neu'r berth uchel a bennir yn yr hysbysiad adfer yn effeithio'n andwyol ar y mwynhad rhesymol a gaiff yr achwynydd o'r eiddo domestig a bennir felly;
(b)na ddylid cymryd unrhyw gamau mewn perthynas â'r gwrych neu'r berth uchel a bennir yn yr hysbysiad adfer i wneud iawn am yr effaith andwyol ar y mwynhad rhesymol a gaiff yr achwynydd o'r eiddo domestig a bennir felly neu i atal ailadrodd yr effaith andwyol honno;
(c)bod y camau a bennir yn yr hysbysiad adfer yn fwy na'r hyn sydd ei angen i wneud iawn am effaith andwyol y gwrych neu'r berth uchel neu i atal ailadrodd yr effaith andwyol honno; neu
(ch)bod y cyfnod a bennir yn yr hysbysiad adfer ar gyfer cymryd y camau a bennir felly yn llai na'r cyfnod y dylid yn rhesymol ei ganiatáu.
(2) Gellir gwneud apêl o dan adran 71(1)(a) o'r Ddeddf gan achwynydd mewn perthynas â hysbysiad adfer a ddyroddwyd gan yr awdurdod perthnasol ar y sail bod y camau a bennir yn yr hysbysiad adfer yn annigonol i wneud iawn am effaith andwyol y gwrych neu'r berth uchel ar y mwynhad rhesymol a gaiff yr achwynydd o'r eiddo domestig a bennir felly neu i atal ailadrodd yr effaith andwyol.
