Changes to Legislation

Pŵer i ddyroddi codau o arferion a argymhellirLL+C
6.—(1) Er mwyn cyfarwyddo awdurdodau bwyd anifeiliaid ac awdurdodau bwyd caiff Gweinidogion Cymru ddyroddi codau o arferion a argymhellir o ran y canlynol—
(a)swyddogaethau a roddir i'r awdurdodau hynny yn rhinwedd eu swydd fel awdurdodau cymwys drwy [F1Reoliad 2017/625] neu odano; neu
(b)gweithredu a gorfodi'r Darpariaethau Mewnforio;
a rhaid i unrhyw god o'r fath gael ei osod gerbron Cynulliad Cenedlaethol Cymru ar ôl ei ddyroddi.
(2) Caiff yr Asiantaeth, ar ôl ymgynghori â Gweinidogion Cymru, roi cyfarwyddyd i awdurdod bwyd anifeiliaid neu awdurdod bwyd yn ei gwneud yn ofynnol iddynt gymryd unrhyw gamau penodedig er mwyn cydymffurfio â chod a ddyroddir o dan y rheoliad hwn.
(3) Wrth arfer y swyddogaethau a roddwyd arnynt fel awdurdodau cymwys drwy [F2Reoliad 2017/625] neu odano ac wrth iddynt weithredu a gorfodi'r Darpariaethau Mewnforio, rhaid i bob awdurdod bwyd anifeiliaid a phob awdurdod bwyd—
(a)rhoi sylw i unrhyw ddarpariaeth berthnasol mewn unrhyw god o'r fath; a
(b)cydymffurfio ag unrhyw gyfarwyddyd a roddir o dan y rheoliad hwn ac sy'n ei gwneud yn ofynnol iddynt gymryd unrhyw gamau penodedig er mwyn cydymffurfio â chod o'r fath.
(4) Mae unrhyw gyfarwyddyd o dan baragraff (2), ar gais yr Asiantaeth, yn orfodadwy drwy orchymyn mandadol.
(5) Rhaid i'r Asiantaeth ymgynghori â Gweinidogion Cymru cyn gwneud cais o dan baragraff (4).
(6) Cyn dyroddi unrhyw god o dan y rheoliad hwn, bydd Gweinidogion Cymru yn rhoi sylw i unrhyw gyngor perthnasol a roddir gan yr Asiantaeth.
