8. Er bod y Gorchymyn hwn yn diddymu Atodlenni 8 a 9 i Ddeddf 1990, mae'r diwygiadau a wnaed gan yr Atodlenni hynny i Ddeddfau eraill yn dal i gael effaith i'r graddau yr oeddent yn cael effaith yn union cyn i'r Gorchymyn hwn ddod i rym, yn ddarostyngedig i unrhyw ddiwygiadau i'r Deddfau eraill hynny a wnaed gan y Gorchymyn hwn.

Rheoliadau Rheoli Peryglon Damweiniau Mawr 1999LL+C
9.—(1) Mae'r paragraff hwn yn gymwys at ddibenion rheoliad 7(11) o Reoliadau Rheoli Peryglon Damweiniau Mawr 1999(1).
(2) Pan fo—
(a)adroddiad diogelwch yn cael ei anfon at yr awdurdod cymwys mewn perthynas â sefydliad yng Nghymru;
(b)yr adroddiad diogelwch hwnnw yn cynnwys gwybodaeth sy'n cyfeirio at wybodaeth mewn adroddiad neu hysbysiad arall a anfonwyd at Asiantaeth yr Amgylchedd yn unol â gofynion a osodwyd gan neu o dan unrhyw ddeddfiad; ac
(c)yr adroddiad neu'r hysbysiad arall wedi ei anfon at Asiantaeth yr Amgylchedd cyn y dyddiad trosglwyddo;
yna, ystyrir bod yr adroddiad neu'r hysbysiad a anfonwyd at Asiantaeth yr Amgylchedd wedi ei anfon at yr asiantaeth briodol.
(3) Yn y paragraff hwn, mae i “asiantaeth briodol”, “sefydliad”, “hysbysiad” ac “adroddiad diogelwch” yr ystyron a roddir i “appropriate agency”, “establishment”, “notification” a “safety report” yn eu tro gan reoliad 2(1) o Reoliadau Rheoli Peryglon Damweiniau Mawr 1999 fel y'u diwygiwyd gan y Gorchymyn hwn.

Rheoliadau Defnyddiau Atgynhyrchiol y Goedwig (Prydain Fawr) 2002LL+C
10.—(1) Mae person sy'n swyddog awdurdodedig at ddibenion Rheoliadau Defnyddiau Atgynhyrchiol y Goedwig (Prydain Fawr) 2002(2) yn union cyn y dyddiad trosglwyddo yn cael ei ystyried yn swyddog awdurdodedig wedi hynny yn rhinwedd y ffaith ei fod wedi ei awdurdodi gan y Comisiynwyr a chan Weinidogion Cymru.
(2) Nid yw is-baragraff (1) yn effeithio ar bwerau'r Comisiynwyr na Gweinidogion Cymru i ddirymu, ar y dyddiad trosglwyddo neu wedi hynny, unrhyw awdurdodiad sydd gan berson neu i adnewyddu'r awdurdodiad hwnnw wedi hynny.

Gorchymyn Iechyd Planhigion (Coedwigaeth) 2005LL+C
11.—(1) Mae person sy'n arolygydd at ddibenion Gorchymyn Iechyd Planhigion (Coedwigaeth) 2005(3) yn union cyn y dyddiad trosglwyddo yn cael ei ystyried yn arolygydd wedi hynny yn rhinwedd y ffaith ei fod wedi ei awdurdodi gan y Comisiynwyr a chan Weinidogion Cymru.
(2) Nid yw is-baragraff (1) yn effeithio ar bwerau'r Comisiynwyr na Gweinidogion Cymru i ddirymu, ar y dyddiad trosglwyddo neu wedi hynny, unrhyw awdurdodiad sydd gan berson neu i adnewyddu'r awdurdodiad hwnnw wedi hynny.

Gorchymyn Sancsiynau Sifil Amgylcheddol (Cymru) 2010LL+C
12.—(1) Yn y paragraff hwn—
ystyr “Deddf 2008” (“the 2008 Act”) yw Deddf Gorfodi Rheoleiddiol a Sancsiynau 2008;
ystyr “Gorchymyn 2010” (“the 2010 Order”) yw Gorchymyn Sancsiynau Sifil Amgylcheddol (Cymru) 2010(4) fel y'i diwygiwyd gan y Gorchymyn hwn.
(2) Mae adran 67 o Ddeddf 2008 yn gymwys i Orchymyn 2010—
(a)fel pe bai cyfnod o un flwyddyn wedi ei roi yn lle cyfnod o dair blynedd yn is-adran (2); a
(b)fel pe bai unrhyw ddarpariaeth yng Ngorchymyn 2010 i roi pŵer i reoleiddiwr i osod sancsiwn sifil ar gyfer trosedd—
(i)wedi ei gwneud o dan neu yn rhinwedd Rhan 3 o Ddeddf 2008; a
(ii)wedi dod i rym ar y dyddiad trosglwyddo.
