Tâl absenoldeb profedigaeth amaethyddol
43.—(1) Mae swm y tâl mewn cysylltiad ag absenoldeb oherwydd profedigaeth yn sgil marwolaeth person yng Nghategori A, am y pedwar diwrnod cyntaf neu, pan fo’r gweithiwr amaethyddol yn gweithio ei oriau sylfaenol ar 4 diwrnod yr wythnos neu lai, nifer y diwrnodau a gyfrifir yn unol ag erthygl 42(3), i’w bennu yn unol â darpariaethau erthygl 36 fel pe bai diwrnod cyntaf absenoldeb y gweithiwr amaethyddol oherwydd profedigaeth yn ddiwrnod cyntaf gwyliau blynyddol y gweithiwr hwnnw. Ar gyfer gweddill unrhyw gyfnod o absenoldeb oherwydd profedigaeth, bydd gan y gweithiwr amaethyddol hawl i gael swm sy’n cyfateb i dâl absenoldeb profedigaeth rhiant statudol sy’n gymwys o bryd i’w gilydd.
(2) Mae unrhyw dâl absenoldeb profedigaeth amaethyddol a delir i’r gweithiwr amaethyddol yn unol ag erthygl 43(1) yn cynnwys unrhyw dâl absenoldeb profedigaeth rhiant statudol y gall y gweithiwr fod â hawl i’w gael ar gyfer yr un cyfnod.
(3) Mae swm y tâl absenoldeb profedigaeth amaethyddol y mae gan weithiwr amaethyddol hawl i’w gael yn sgil marwolaeth person yng Nghategori B neu C i’w bennu yn unol â darpariaethau erthygl 36 fel pe bai diwrnod cyntaf absenoldeb y gweithiwr amaethyddol oherwydd profedigaeth yn ddiwrnod cyntaf gwyliau blynyddol y gweithiwr hwnnw.
