The Counsellors of State in Council

Whereas Her Majesty in pursuance of the Regency Acts 1937 to 1953, was pleased, by Letters Patent dated the 15th day of June 1990, to delegate to the six Counsellors of State therein named or any two or more of them full power and authority during the period of Her Majesty’s absence from the United Kingdom to summon and hold on Her Majesty’s behalf Her Privy Council and to signify thereat Her Majesty’s approval for anything for which Her Majesty’s approval in Council is required:

And whereas a draft of this Order has been approved by a resolution of each House of Parliament:

Now, therefore, His Royal Highness The Prince Charles, Prince of Wales, and His Royal Highness The Prince Edward, being authorised thereto by the said Letters Patent, and in pursuance of the powers conferred by paragraph 1 of Schedule 1 to the Northern Ireland Act (1)1974, and all other powers enabling Her Majesty, and by and with the advice of Her Majesty’s Privy Council, do on Her Majesty’s behalf order, and it is hereby ordered, as follows:—

Title and commencement

1.  This Order may be cited as the Appropriation (No. 2) (Northern Ireland) Order 1990 and shall come into operation forthwith.

Interpretation

2.  The Interpretation Act (Northern Ireland) (2)1954 shall apply to Article 1 and the following provisions of this Order as it applies to a Measure of the Northern Ireland Assembly.

Issue of sum out of the Consolidated Fund for year ending 31st March 1991

3.  The Department of Finance and Personnel may issue out of the Consolidated Fund and apply towards making good the supply granted to Her Majesty for the service of the year ending on 31st March 1991 the sum of two thousand, four hundred and ninety-six million, five hundred and sixty-four thousand, nine hundred pounds.

Power for Department of Finance and Personnel to borrow

4.—(1) Subject to paragraph (2), the Department of Finance and Personnel may borrow on the credit of the aforesaid sum, any sum or sums not exceeding in the whole one thousand, two hundred and forty-eight million pounds.

(2) Any money so borrowed shall be repaid, with any interest due thereon, out of the Consolidated Fund at any date not later than 31st March 1991.

Appropriation of grants

5.—(1) The sum granted by Article 3 out of the Consolidated Fund is appropriated for the several services and purposes specified in the Schedule.

(2) In addition to the sum granted by Article 3 out of the Consolidated Fund, there may be applied as appropriations in aid of the grants for the several services and purposes specified in the Schedule the sums respectively specified in column 3.

For expenditure by the Department of Health and Social Services on departmental administration of health and personal social services (including the Management Executive), the Office of the Registrar General, the census of Northern Ireland and miscellaneous licensing; on administration of social security and certain other services including a grant to the Northern Ireland Housing Executive for the administration costs of the Housing Benefit and Transitional Payments Schemes and on an international subscription; on administration of the Belfast Social Security Centre and F6 Lisahally as agent for the Department of Social Security; and on miscellaneous health and personal social services including grants to voluntary bodies, research, welfare foods and on payments to overseas organisations in respect of health and personal social services and a grant in aid.55,488,000  42,429,000

This Order authorises the issue out of the Consolidated Fund of Northern Ireland of a further sum for the year ending on 31st March 1991 and appropriates that sum for specified services in Northern Ireland. It also authorises the application of certain sums as appropriations in aid for the year ending on 31st March 1991.
