The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 78(2) and 104(1) of the Public Services Reform (Scotland) Act 2010(1) and all other powers enabling them to do so.

In accordance with section 104(2)(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement

1.  These Regulations may be cited as the Registration of Social Workers and Social Service Workers in Care Services (Scotland) Amendment Regulations 2014 and come into force on 30th June 2014.

Amendment of the Registration of Social Workers and Social Service Workers in Care Services (Scotland) Regulations 2013

2.—(1) The Registration of Social Workers and Social Service Workers in Care Services (Scotland) Regulations 2013(3) are amended as follows.

(2) In regulation 5(7) (requirements on social service workers) for “of the Schedule” in each place it occurs substitute “of Table A in the Schedule”.

(3) After regulation 5(7) insert—

(7A) In the case of a social service worker of a description specified in column 1 of Table B in the Schedule who works in such a role on the date specified in column 2 of Table B in the Schedule—

(a)paragraph (1) does not apply until the date specified in the corresponding entry in column 3 of Table B in the Schedule;

(b)that worker must be registered by the date specified in column 3 of Table B in the Schedule; and

(c)paragraphs (2), (3), (5) and (6) do not apply..

(4) In the Schedule—

(a)the table becomes Table A;

(b)for the description of the table “Table with dates of mandatory registration for certain social service workers” substitute “Dates of mandatory registration for certain social service workers”; and

(c)after the table, insert—

EXPLANATORY NOTE

(This note is not part of the Regulations)

The Registration of Social Workers and Social Service Workers in Care Services (Scotland) Regulations 2013 (“the principal Regulations”) requires social service workers to register with the Scottish Social Services Council in order to work in a care service. For social service workers already in post on the coming into force of the principal Regulations, mandatory registration only applies to those social service workers named in the Schedule from the dates set out in that Schedule.

These Regulations amend the Schedule to the principal Regulations by inserting a new table which specifies two additional descriptions of social service workers, supervisor in a care at home service and supervisor in a housing support service, and sets a mandatory registration date of 30th June 2017 for workers who worked in the relevant role on 30th June 2014.

Section 104(2) has been modified by paragraph 5 of schedule 3 to the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10).

“Care at home service” and “housing support service” have the meaning given by article 1(2) of the Regulation of Care (Social Service Workers) (Scotland) Order 2005 (S.S.I. 2005/318 as amended by S.S.I. 2014/129).
