The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 97C(4), (5)(b) and (f), (6)(b), 97H(6) and 97N(1) and (3) of the Land Reform (Scotland) Act 2003(1) and all other powers enabling them to do so.
In accordance with section 98(5) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
2003 asp 2. Sections 97C, 97H and 97N were inserted by the Community Empowerment (Scotland) Act 2015 (asp 6), section 74. Section 98(1) of the Land Reform (Scotland) Act 2003 (asp 2) contains definitions of ‘Ministers’ and ‘prescribed’ relevant to the exercise of the statutory powers under which these Regulations are made.
