The Scottish Ministers make the following Order in exercise of the powers conferred by section 302(7) and (8) of the Criminal Procedure (Scotland) Act 1995(1) and all other powers enabling them to do so.
In accordance with section 302(8)(b) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1995 c. 46. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). Section 302(7) of the Criminal Procedure (Scotland) Act 1995 will be amended by section 50(1) of the Criminal Proceedings etc. (Reform) (Scotland) Act 2007 (asp 6). Section 50(1) will come into force on 10th March 2008.
