The Scottish Ministers make the following Order in exercise of the powers conferred by section 41(3) of the Private Rented Housing (Scotland) Act 2011(1).

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Private Rented Housing (Scotland) Act 2011 (Commencement No. 7) Order 2015 and comes into force on 22nd September 2015.

(2) In this Order “the Act” means the Private Rented Housing (Scotland) Act 2011.

Appointed days

2.—(1) 22nd September 2015 is the day appointed for the coming into force of the provisions of the Act specified in paragraph (2).

(2) The provisions are the following subsections of section 35 (landlord application to private rented housing panel)—

(a)subsection (1);

(b)subsection (4) for the purpose of enabling the Scottish Ministers to make regulations under sections 28B(1) and 28C(11) of the Housing (Scotland) Act 2006(2); and

(c)subsection (8).

(3) 1st December 2015 is the day appointed for the coming into force of subsections (2), (4) (in so far as not already in force) and (5) to (7) of section 35 of the Act.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force section 35 (landlord application to private rented housing panel) of the Private Rented Housing (Scotland) Act 2011 (“the Act”) with the exception of subsection (3) which will be repealed by section 25(11) of the Housing (Scotland) Act 2014(3)).

The Bill for the Act received Royal Assent on 20th April 2011. Part 5 of the Act (sections 38 to 41: general provisions) came into force the following day. The provisions of the Act commenced by earlier commencement orders are detailed in the table below.
