1994 CHAPTER 10

An Act to remove the limit imposed by subsection (2) of section 56 of the Race Relations Act 1976 on the amount of compensation which may be awarded under that section and to make provision for interest in connection with sums so awarded; and for connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Removal of limit on amount of awards.E+W+S

(1)In section 56 of the M1Race Relations Act 1976 (remedies on complaint to [F1employment tribunal] in respect of acts of racial discrimination), subsection (2) (limit on the amount of compensation) shall cease to have effect.

2 Power to make provision as to interest in relation to awards.E+W+S

(1)In section 56 of the Race Relations Act 1976, at the end there shall be inserted—

(5)The Secretary of State may by regulations make provision—

(a)for enabling a tribunal, where an amount of compensation falls to be awarded under subsection (1)(b), to include in the award interest on that amount; and

(b)specifying, for cases where a tribunal decides that an award is to include an amount in respect of interest, the manner in which and the periods and rate by reference to which the interest is to be determined;

and the regulations may contain such incidental and supplementary provisions as the Secretary of State considers appropriate.

(6)The Secretary of State may by regulations modify the operation of any order made under paragraph 6A of Schedule 9 to the Employment Protection (Consolidation) Act 1978 (power to make provision as to interest on sums payable in pursuance of [F3employment tribunal] decisions) to the extent that it relates to an award of compensation under subsection (1)(b).

(2)In section 74(2) of that Act (parliamentary procedure in relation to certain orders and regulations), after the words “under section” there shall be inserted “ 56(5), (6) or ”.

3 Short title, repeals, commencement and extent.E+W+S

(1)This Act may be cited as the Race Relations (Remedies) Act 1994.

(2)The enactments mentioned in the Schedule to this Act are hereby repealed to the extent specified in the third column of the Schedule.

(3)This Act shall come into force at the end of the period of two months beginning with the date on which it is passed.

(4)This Act does not extend to Northern Ireland.
