The Secretary of State for Transport, being a Minister designated(1)for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the international carriage of passengers by road, in exercise of the powers conferred by that section, section 60(1) and (1A) of the Public Passenger Vehicles Act 1981(3) and, with the consent of the Treasury, in exercise of the powers conferred by section 56(1) of the Finance Act 1973(4) and of all other enabling powers and (in respect of the Regulations insofar as made under the said Act of 1981), after consultation with representative organisations in accordance with section 61(2) of the said Act of 1981, hereby makes the following Regulations:

1.  These Regulations may be cited as the Road Transport (International Passenger Services) (Amendment) Regulations 1987 and shall come into force on 1st November 1987.

2.—(1) The Road Transport (International Passenger Services) Regulations 1984(5) shall be amended in accordance with the following provisions of this regulation.

(2) In regulations 5(2) and 6(2)

(a)after the words “Act of 1981” where they first occur there shall be inserted the words “and Parts I and II of the Transport Act 1985”; and

(b)in paragraph (b) for the words “section 30 of the Act of 1981 there shall be substituted the following section” there shall be substituted “section 6 of the Transport Act 1985 there shall be substituted the following section and section 35 of that Act shall be omitted” and in the fourth line for “30” there shall be substituted “6”.

(3) In regulation 14 —

(a)in paragraph (3) for the words “section 30 of the Public Passenger Vehicles Act 1981” there shall be substituted the words “section 6 of the Transport Act 1985” and for “£110” there shall be substituted “£125”; and

(b)in paragraph (4) for the words “when the application is made” there shall be substituted the words “before the authorisation is issued”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Road Transport (International Passenger Services) Regulations 1984. They provide that

(a)the fee of £110 prescribed by regulation 14(3) payable on application for an authorisation under the Regulations shall be increased to £125, and

(b)the fee of £25 prescribed by regulation 14(4) in respect of each year of validity of a regular, or special regular, service authorisation shall be payable before the authorisation is issued rather than when the application for the authorisation is made.

They also amend the 1984 Regulations for the avoidance of doubt as consequence of the coming into force by virtue of the Transport Act 1985 (Commencement No. 6) Order 1986 (S.I. 1986/1794 (C.63)) of the repeal of section 30 of the Public Passenger Vehicles Act 1981 by section 139(3) of the Transport Act 1985. The requirement of section 30 of the 1981 Act was replaced by the requirement of section 6 of the 1985 Act for the registration of certain local services outside London.
