The Welsh Ministers, after consultation with the council for the principal area part of which is comprised in the Pembrokeshire Coast National Park and in exercise of the powers conferred by sections 63(1) and (5) of, and paragraphs 1(2) and 2(3) of Schedule 7 to, the Environment Act 1995(1) and now vested in them(2), make the following Order:

Title, commencement and application

1.—(1) The title of this Order is the National Park Authorities (Wales) (Amendment) Order 2007.

(2) This Order comes into force on 31 December 2007 and applies in relation to Wales.

Interpretation

2.  In this Order —

“the principal Order” (“y prif Orchymyn”) means the National Park Authorities (Wales) Order 1995(3).

Amendment of the National Park Authorities (Wales) Order 1995

3.—(1) The principal Order is amended in accordance with the following paragraphs.

(2) In Part I of Schedule 2 to the principal Order for—

Explanatory Note

(This note is not part of the Order)

This Order, which comes into force on 31 December 2007 amends the National Park Authorities (Wales) Order 1995 (the principal Order).

Article 3 of this Order amends Parts I and II of Schedule 2 to the principal Order so that the membership of the Pembrokeshire Coast National Park Authority increases from 15 to 18. The total number of members consists of 12 local authority members and 6 members appointed by the Welsh Ministers.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.

The powers conferred on the Secretary of State by sections 63(1) and (5) of, and paragraphs 1(2) and 2(3) of Schedule 7 to, the Environment Act 1995 were, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999, SI 1999/672. By virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006, the functions conferred on the National Assembly for Wales are now exercisable by the Welsh Ministers.
