Mae Gweinidogion Cymru, drwy arfer y pwerau a roddwyd iddynt gan adran 32(3) o Ddeddf Addysg Bellach a Hyfforddiant 2007, drwy hyn yn gwneud y Gorchymyn a ganlyn:

1.  Enw'r Gorchymyn hwn yw Gorchymyn Deddf Addysg Bellach a Hyfforddiant 2007 (Cychwyn Rhif 1) (Cymru) 2007.

Darpariaeth yn dod i rym

2.  Daw adran 18(5) o Ddeddf Addysg Bellach a Hyfforddiant 2007 i rym ar 23 Rhagfyr 2007.

(Nid yw'r nodyn hwn yn rhan o'r Gorchymyn)

Y Gorchymyn hwn yw'r Gorchymyn Cychwyn cyntaf a wneir gan Weinidogion Cymru o dan Ddeddf Addysg Bellach a Hyfforddiant 2007(1) ac fe ddaw ag adran 18(5) o'r Ddeddf honno i rym ar 23 Rhagfyr 2007. Mae adran 18(5) yn gwneud darpariaeth i Weinidogion Cymru lunio datganiad polisi am arferiad eu pwerau o dan adran 57 o Ddeddf Addysg Bellach ac Uwch 1992(2) (“Deddf 1992”), adolygu'r datganiad hwnnw yn rheolaidd ac, os ydynt yn barnu bod hynny'n briodol, ddiwygio'r datganiad hwnnw. Mae adran 18(5) yn darparu hefyd bod rhaid i Weinidogion Cymru, wrth lunio neu ddiwygio'r datganiad hwnnw, ymgynghori fel y maent yn barnu ei bod yn briodol ac ystyried unrhyw sylwadau a gyflwynir iddynt am y polisi sydd i'w nodi yn y datganiad. Ar ben hynny, rhaid i Weinidogion Cymru osod y datganiad (neu'r datganiad diwygiedig) gerbron Cynulliad Cenedlaethol Cymru, cyhoeddi'r datganiad (neu'r datganiad diwygiedig) a rhoi sylw i'r datganiad a gyhoeddwyd ddiweddaraf wrth arfer (neu benderfynu ar arfer) unrhyw un o'u pwerau o dan adran 57 o Ddeddf 1992 mewn perthynas â sefydliad.
