Pwerau i wahardd personau, tystiolaeth etc

17.—(1) Os bydd y person penodedig, yn ystod unrhyw gam mewn gwrandawiad neu ymchwiliad, o'r farn bod unrhyw un o'r rhesymau ym mharagraff (2) yn gymwys, caiff y person penodedig rwystro unrhyw berson rhag—

(a)rhoi tystiolaeth;

(b)croesholi person sy'n rhoi tystiolaeth; neu

(c)gyflwyno unrhyw fater.

(2) Y rhesymau yw—

(a)na ddarparwyd y dystiolaeth neu'r mater o fewn y terfynau amser perthnasol;

(b)nad oedd y mater, rywfodd arall, wedi ei darparu yn unol ag unrhyw ddarpariaeth o'r Rheoliadau hyn neu'n unol ag unrhyw gyfarwyddyd a roddwyd neu ofyniad a wnaed gan y person penodedig o dan y rheoliadau hyn;

(c)bod y dystiolaeth neu'r mater yn amherthnasol neu'n ailadroddus; neu

(ch)bod y person yn ymddwyn, neu wedi ymddwyn, yn aflonyddgar yn y gwrandawiad neu ymchwiliad.

(3) Heb leihau effaith y pwerau ym mharagraff (1), os bydd unrhyw berson yn ymddwyn yn aflonyddgar yn y gwrandawiad neu ymchwiliad, caiff y person penodedig—

(a)wneud yn ofynnol bod y person hwnnw'n ymadael;

(b)atal y person hwnnw rhag cymryd rhan yn y gwrandawiad neu'r ymchwiliad; neu

(c)caniatáu i'r person hwnnw aros, neu gymryd rhan, yn y gwrandawiad neu'r ymchwiliad, ond ar amodau penodedig yn unig.

(4) Pan fo'r person penodedig yn gwrthod caniatáu, o dan baragraff (3), i berson roi tystiolaeth ar lafar, caiff y person hwnnw gyflwyno unrhyw dystiolaeth neu fater arall mewn ysgrifen i'r person penodedig cyn cau'r gwrandawiad neu'r ymchwiliad (ond mae hyn yn ddarostyngedig i baragraff (1)).
