The Welsh Ministers, in exercise of the powers conferred by section 186 of the Regulation and Inspection of Social Care (Wales) Act 2016(1) and sections 9(1), 10 and 140(1) of the Adoption and Children Act 2002(2), make the following Regulations:

Title and commencement

1.—(1) The title of these Regulations is the Regulation and Inspection of Social Care (Wales) Act 2016 (Consequential Amendments to Secondary Legislation) Regulations 2017.

(2) These Regulations come into force on 3 April 2017.

Amendments

2.  Schedule 1 (amendments consequential upon the Regulation and Inspection of Social Care (Wales) Act 2016) has effect.

Revocations

3.  Schedule 2 (revocations) has effect.

1.—(1) The Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975(3) is amended as follows.

(2) In articles 3(1)(i) and 4(1)(k)—

(a)for “the Care Council for Wales” substitute “Social Care Wales”;

(b)for “Part IV of the Care Standards Act 2000” substitute “Part 4 of the Regulation and Inspection of Social Care (Wales) Act 2016”.

Representation of the People (England and Wales) Regulations 2001

Care Homes (Wales) Regulations 2002

4.—(1) The Care Homes (Wales) Regulations 2002(6) are amended as follows.

(2) In regulation 9 (fitness of registered manager), in paragraph (6) for “the Care Council for Wales” substitute “Social Care Wales”.

(3) In Schedule 2 (information and documents to be available in respect of persons carrying on, managing, or working at, care homes), in paragraph 5A for “the Care Council for Wales” substitute “Social Care Wales”.

Children’s Homes (Wales) Regulations 2002

5.—(1) The Children’s Homes (Wales) Regulations 2002(7) are amended as follows.

(2) In the English text, in each of the provisions mentioned in paragraph (3) for “the Care Council for Wales” substitute “Social Care Wales”.

(3) The provisions are—

(a)regulation 8(2E) (fitness of manager);

(b)regulation 26(2F) and (2G) (fitness of workers);

Registration of Social Care and Independent Health Care (Wales) Regulations 2002

6.—(1) The Registration of Social Care and Independent Health Care (Wales) Regulations 2002(8) are amended as follows.

(2) In each of the provisions mentioned in paragraph (3) for “the Care Council for Wales” substitute “Social Care Wales”.

(3) The provisions are—

(a)Schedule 1, paragraphs 1(ba), 2(ca) and 16(ea) (information to be supplied on an application for registration as a person who carries on or manages an establishment or agency);

(b)Schedule 3, paragraphs 2A, 2B and 2C (information and documents to be supplied for registration as the manager of an establishment or agency).

Welsh Language Schemes (Public Bodies) Order 2002

7.—(1) The Welsh Language (Public Bodies) Order 2002(9) is amended as follows.

Local Authorities (Goods and Services) (Public Bodies) (Wales) Order 2002

8.—(1) The Local Authorities (Goods and Services) (Public Bodies) (Wales) Order 2002(10) is amended as follows.

Domiciliary Care Agencies (Wales) Regulations 2004

9.—(1) The Domiciliary Care Agencies (Wales) Regulations 2004(11) are amended as follows.

(2) In each of the provisions mentioned in paragraph (3) for “the Care Council for Wales” substitute “Social Care Wales”.

(3) The provisions are—

(a)regulation 10(6) (fitness of manager);

(b)Schedule 2, paragraph 6B (information required in respect of registered providers and managers of an agency and persons nominated to deputise for a registered person).

10.—(1) The Adoption Agencies Regulations 2005(12) are amended as follows.

Local Authority (Adoption) (Miscellaneous Provisions) Regulations 2005

12.—(1) The Local Authority (Adoption) (Miscellaneous Provisions) Regulations 2005(14) are amended as follows.

(2) In regulation 2 (interpretation), in the definition of “social worker”—

(a)at the end of paragraph (b) omit “or”;

(b)at the end of paragraph (c) omit the full stop and insert—

; or

(d)the register maintained by Social Care Wales under section 80 of the Regulation and Inspection of Social Care (Wales) Act 2016.

National Assembly for Wales (Representation of the People) Order 2007

13.—(1) The National Assembly for Wales (Representation of the People) Order 2007(15) is amended as follows.

(2) In Schedule 1 (absent voting at Assembly elections), in paragraph 4 (additional requirements for applications on grounds of severe sight-impairment or other disability), in sub-paragraph (2)(n) for “section 56 of the Care Standards Act 2000” substitute “section 80 of the Regulation and Inspection of Social Care (Wales) Act 2016”.

Review of Children’s Cases (Wales) Regulations 2007

14.—(1) The Review of Children’s Cases (Wales) Regulations 2007(16) are amended as follows.

(2) In regulation 8 (persons who may provide an LPA certificate), in paragraph (4), in the definition of “registered social worker” for “the Care Council for Wales” substitute “Social Care Wales”.

Local Authority Adoption Service (Wales) Regulations 2007

16.—(1) The Local Authority Adoption Service (Wales) Regulations 2007(18) are amended as follows.

(2) In regulation 2(1) (interpretation), for the definition of “social worker” substitute—

“social worker” (“gweithiwr cymdeithasol”) means a person who is registered as a social worker—

(a)

in the register maintained by Social Care Wales under section 80 of the Regulation and Inspection of Social Care (Wales) Act 2016; or

(b)

in Part 16 of the register maintained by the Health and Care Professions Council under article 5 of the Health and Social Work Professions Order 2001;.

Mental Health (Approved Mental Health Professionals) (Approval) (England) Regulations 2008

17.—(1) The Mental Health (Approved Mental Health Professionals) (Approval) (England) Regulations 2008(19) are amended as follows.

(2) In regulation 2 (interpretation)—

(a)omit the definition of “Care Council for Wales”;

(b)in the appropriate place insert—

“Social Care Wales” has the meaning given by section 67 of the Regulation and Inspection of Social Care (Wales) Act 2016;.

(3) In regulation 3(3) (granting approval) for “the Care Council for Wales” substitute “Social Care Wales”.

Mental Health (Approval of Persons to be Approved Mental Health Professionals) (Wales) Regulations 2008

18.—(1) The Mental Health (Approval of Persons to be Approved Mental Health Professionals) (Wales) Regulations 2008(20) are amended as follows.

(2) In regulation 2 (interpretation)—

(a)omit the definition of “Care Council for Wales”;

(b)in the appropriate place insert—

“Social Care Wales” (“Gofal Cymdeithasol Cymru”) has the meaning given by section 67 of the Regulation and Inspection of Social Care (Wales) Act 2016;.

(3) In each of the provisions mentioned in paragraph (4) for “the Care Council for Wales” substitute “Social Care Wales”.

(4) The provisions are—

(a)regulation 3(1)(c) (granting approval);

Independent Review of Determinations (Adoption and Fostering) Regulations 2009

19.—(1) The Independent Review of Determinations (Adoption and Fostering) Regulations 2009(21) are amended as follows.

(2) In regulation 2 (interpretation), in the definition of “social worker” for “the Care Council for Wales under section 56 of the Care Standards Act 2000” substitute “Social Care Wales under section 80 of the Regulation and Inspection of Social Care (Wales) Act 2016”.

20.—(1) The Mental Capacity (Deprivation of Liberty: Assessments, Standard Authorisations and Disputes about Residence) (Wales) Regulations 2009(22) are amended as follows.

(2) In regulation 2(1) (interpretation)—

(a)omit the definition of “Care Council for Wales”;

(b)in the appropriate place insert—

“Social Care Wales” (“Gofal Cymdeithasol Cymru”) has the meaning given by section 67 of the Regulation and Inspection of Social Care (Wales) Act 2016.

21.—(1) The Independent Review of Determinations (Adoption and Fostering) (Wales) Regulations 2010(23) are amended as follows.

(2) In regulation 2 (interpretation), in the definition of “social worker” for “the Care Council for Wales under section 56 of the Care Standards Act 2000” substitute “Social Care Wales under section 80 of the Regulation and Inspection of Social Care (Wales) Act 2016”.

Care Planning, Placement and Case Review (England) Regulations 2010

22.—(1) The Care Planning, Placement and Case Review (England) Regulations 2010(24) are amended as follows.

(2) In regulation 46 (qualifications and experience for independent reviewing officers), in paragraph (1) for “the Care Council for Wales under section 56 of the Care Standards Act 2000” substitute “Social Care Wales under section 80 of the Regulation and Inspection of Social Care (Wales) Act 2016”.

Fostering Services (England) Regulations 2011

23.—(1) The Fostering Services (England) Regulations 2011(25) are amended as follows.

(2) In regulation 23 (constitution and membership of fostering panel), in paragraph (10)(b) for “the Care Council for Wales under section 56 of the Care Standards Act 2000” substitute “Social Care Wales under section 80 of the Regulation and Inspection of Social Care (Wales) Act 2016”.

Arrangements for Placement of Children by Voluntary Organisations and Others (England) Regulations 2011

24.—(1) The Arrangements for Placement of Children by Voluntary Organisations and Others (England) Regulations 2011(26) are amended as follows.

(2) In regulation 18 (reviews of children’s cases), in paragraph (2) for “the Care Council for Wales under section 56 of the Care Standards Act 2000” substitute “Social Care Wales under section 80 of the Regulation and Inspection of Social Care (Wales) Act 2016”.

Education (Student Support) Regulations 2011

25.—(1) The Education (Student Support) Regulations 2011(27) are amended as follows.

(2) In regulation 159 (eligible postgraduate students)—

(a)at the end of paragraph (4)(a)(iv) omit “or”;

(b)after paragraph (4)(a)(v) insert—

or

(vi)any allowance, bursary or award of similar description made under section 116(2)(a) of the Regulation and Inspection of Social Care (Wales) Act 2016 which includes payment for meeting additional expenditure incurred by A by reason of A’s disability;.

Mental Health (Care Co-ordination and Care and Treatment Planning) (Wales) Regulations 2011

26.—(1) The Mental Health Care Co-ordination and Care Treatment Planning (Wales) Regulations 2011(28) are amended as follows.

(2) In Schedule 1 (professional requirements), in paragraph 1(a) for “the Care Council for Wales” substitute “Social Care Wales”.

Mental Health (Primary Care Referrals and Eligibility to Conduct Primary Mental Health Assessments) (Wales) Regulations 2012

Education (Student Support) (Wales) Regulations 2015

30.—(1) The Education (Student Support) (Wales) Regulations 2015(32) are amended as follows.

(2) In regulation 115 (eligible postgraduate students)—

(a)at the end of paragraph (4)(a)(iv) omit “or”;

(b)after paragraph (4)(a)(v) insert—

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made under section 186 of the Regulation and Inspection of Social Care (Wales) Act 2016 (“the Act”) and make amendments to secondary legislation as a consequence of the commencement of Parts 2 to 11 of the Act.

Part 3 of the Act (Social Care Wales) provides for the continuation of the body corporate called the Care Council for Wales (which was established by section 54 of the Care Standards Act 2000), it renames that body and restates and modifies the body’s original functions and confers additional functions.

Regulation 2 and Schedule 1 make consequential amendments to secondary legislation.

Regulation 3 and Schedule 2 specify the secondary legislation revoked by these Regulations.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As result a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations. A copy can be obtained from the Department of Health and Social Services, Welsh Government, Cathays Park, Cardiff, CF10 3NQ.
