Mae Gweinidogion Cymru yn gwneud y Gorchymyn a ganlyn drwy arfer y pwerau a roddir iddynt gan adrannau 151(2) a 207(2) o Ddeddf Cydraddoldeb 2010(1).
Yn unol ag adran 209(2) a (3)(b) o’r Ddeddf honno, gosodwyd drafft o’r Gorchymyn hwn gerbron Senedd Cymru ac fe’i gymeradwywyd ganddi drwy benderfyniad.
Cyn gwneud y Gorchymyn hwn, yn unol ag adran 152(2) o Ddeddf Cydraddoldeb 2010, mae Gweinidogion Cymru wedi ymgynghori â’r Comisiwn Cydraddoldeb a Hawliau Dynol.

2010 p. 15. Mae adran 151(2) yn galluogi Gweinidogion Cymru i ddiwygio Rhan 2 o Atodlen 19 drwy Orchymyn, er mwyn ychwanegu awdurdod Cymreig perthnasol at yr awdurdodau sy’n ddarostyngedig i ddyletswydd cydraddoldeb y sector cyhoeddus o dan adran 149(1). Mae “relevant Welsh authority” wedi ei ddiffinio yn adran 157(2). Amnewidiwyd adran 157(2) gan baragraff 84(2) o Atodlen 6 i Ddeddf Cymru 2017 (p. 4).
