Mae Gweinidogion Cymru yn gwneud y Rheoliadau hyn drwy arfer y pwerau a roddir gan—
Erthyglau 34(6), 47(2)(b), 54(4)(a) a (b) a 144(6)(a) o Reoliad (EU) 2017/625 Senedd Ewrop a’r Cyngor ar reolaethau swyddogol a gweithgareddau swyddogol eraill a gyflawnir i sicrhau y cymhwysir y gyfraith o ran bwyd a bwyd anifeiliaid, rheolau ynghylch iechyd a lles anifeiliaid, iechyd planhigion a chynhyrchion diogelu planhigion(1);
Erthyglau 53(1)(b) a 57a(6)(a) o Reoliad (EC) Rhif 178/2002 Senedd Ewrop a’r Cyngor sy’n gosod egwyddorion a gofynion cyffredinol cyfraith bwyd, yn sefydlu Awdurdod Diogelwch Bwyd Ewrop ac yn gosod gweithdrefnau o ran materion diogelwch bwyd(2).
Cynhaliwyd ymgynghoriad fel sy’n ofynnol gan Erthygl 144(7) o Reoliad (EU) 2017/625 ac fel sy’n ofynnol gan Erthygl 9 o Reoliad (EC) Rhif 178/2002.
1.—(1) Enw’r Rheoliadau hyn yw Rheoliadau Rheolaethau Swyddogol (Mewnforio Bwyd a Bwyd Anifeiliaid Risg Uchel Nad Ydynt yn Dod o Anifeiliaid) (Diwygio Rheoliad Gweithredu’r Comisiwn (EU) 2019/1793) (Cymru) 2024.
(2) Mae’r Rheoliadau hyn—
(a)yn rhychwantu Cymru a Lloegr;
(b)yn gymwys o ran Cymru;
(c)yn dod i rym ar 7 Mawrth 2024.
2.—(1) Mae Rheoliad Gweithredu’r Comisiwn (EU) 2019/1793 ar gynyddu dros dro reolaethau swyddogol a mesurau brys sy’n rheoli mynediad i’r Undeb i nwyddau penodol o drydydd gwledydd penodol(3) wedi ei ddiwygio fel a ganlyn.
(2) Yn Erthygl 3 (samplu a dadansoddiadau)—
(a)ar ôl paragraff (e) mewnosoder—
“(ea)for food listed in Annex 2 due to the risk of presence of Listeria, the sampling and the analyses for the control of Listeria must be performed in accordance with the sampling procedures and the analytical reference methods laid down in Annex 3a;”

(6) The analytical report referred to in Article 10(3) of this Regulation must be issued by a laboratory accredited for the analysis of PCP in food and feed in accordance with BS EN ISO/IEC 17025:2017 “General requirements for the competence of testing and calibration laboratories” (published by the British Standards Institution on 30 June 2018 (ISBN 978 0 539 01414 3), and available from the British Standards Institution at https://knowledge.bsigroup.com). The analytical report must indicate: (a) the results of sampling and analysis for the presence of PCP, performed by the competent authorities of the country of origin or of the country where the consignment is consigned from if that country is different from the country of origin; (b) the measurement uncertainty of the analytical result; (c) the limit of detection (LOD) of the analytical method; (d) the limit of quantification (LOQ) of the analytical method. The extraction before analysis must be performed with an acidified solvent. The analysis must be carried out according to the modified version of the QuEChERS method or according to an equally reliable method. Mae’r Rheoliadau hyn yn diwygio, o ran Cymru, Reoliad Gweithredu’r Comisiwn (EU) 2019/1793 ar gynyddu dros dro reolaethau swyddogol a mesurau brys sy’n rheoli mynediad i’r Undeb i nwyddau penodol o drydydd gwledydd penodol (EUR 2019/1793).
Mae rheoliad 2 yn gwneud darpariaeth i ddiweddaru’r rhestrau o fwyd a bwyd anifeiliaid risg uchel nad ydynt yn dod o anifeiliaid yn Atodiadau 1 a 2 i EUR 2019/1793. Mae rheoliad 2(4) a (5), ac Atodlenni 1 a 2, yn amnewid yr Atodiadau hynny.
